Background

Brett joined Finlaysons in mid-2022 and works in our Insurance team. He previously worked at South Australia’s Crown Solicitor’s Office as a solicitor in their civil litigation section.

Brett takes pride and understands the importance of quickly establishing rapport and good working relationships with his clients to facilitate transparent communication to manage litigation matters efficiently and effectively.

 

Since joining Finlaysons, Brett has worked across a range of litigation areas with a specific focus on Third Party Compensation Motor Vehicle Accident Claims, general insurance, personal injury, medical negligence and malpractice matters, and coronial investigations.

Experience

Brett’s recent experience includes acting as the lead instructing solicitor in a 4 week Supreme Court trial defending a government department in early 2022. The claim against the government department included allegations of unlawful arrest, battery and assault, false imprisonment, trespass, malicious prosecution and misfeasance in public office.

Brett appears for his clients in the Magistrates, District, Supreme and Coroner’s Courts of South Australia, as well as in the South Australia Employment Tribunal and Federal Court. Brett has prepared for and appeared on for his clients to argue interlocutory applications and other contested hearings and has instructed senior counsel and junior counsel in similar circumstances.

Brett’s experience also includes appearing for his clients at settlement conferences and mediations.

Insurance Experience

Defending and conducting civil litigation in Magistrates, District and Supreme Courts of South Australia on behalf of the State’s indemnity insurer and or directly for government agencies which required the following tasks:

  • Providing advice on potential liability and quantum
  • Preparing court documents
  • Preparing for and arguing interlocutory application and other contested hearings
  • Instructing senior and junior counsel at trial and for contested and interlocutory hearings
  • Appearing for clients at mediations and settlement conferences
  • Proofing witnesses and drafting witness statements

Assist senior solicitors with conduct of large coronial inquests.

Conduct of coronial investigations which involved:

  • Liaising with SA Health practitioners to attend statement interviews
  • Assist staff prepare their affidavit for the Coroner
  • Provide advice to SA Health on the potential risks to the relevant health network arising from the investigation process
  • Prepare advice to SA Health in respect of matters listed for affidavit only inquest
