Sanity prevails in a unanimous High Court decision confirming that landlords will not be forced to pay GST on leases once they sell a property. The decision overturned the previous Federal Court decision that implied that landlords had to pay GST on leases even after they sold the property and no longer received rent. The decision also confirms that a purchaser of residential premises that intends to lease those premises will have a GST adjustment if they purchase the premises as a GST-free going concern.
